To the maximum extent permitted by law, LMT's total aggregate liability arising out of or relating to the Site shall not exceed one hundred U.S. dollars (USD $100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In such jurisdictions, the exclusions and limitations above apply to the fullest extent permitted by law.
You agree to defend, indemnify, and hold harmless LMT Commercial Realty, LLC and its officers, directors, members, employees, agents, and service providers from and against any and all claims, damages, liabilities, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Site or your violation of these Terms.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site shall be resolved exclusively through final and binding arbitration, rather than in court, except that either party may bring an individual action in small claims court if it qualifies. The arbitration shall be conducted in Wilmington, Delaware, in accordance with the rules of the American Arbitration Association then in effect. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
You and LMT each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You and LMT each waive any right to a jury trial and any right to participate in a class action, class arbitration, or representative proceeding.
You may opt out of this arbitration agreement by sending written notice within thirty (30) days of first accepting these Terms to: LMT Commercial Realty, LLC, 1117 N. Franklin Street, Suite A, Wilmington, Delaware 19806. Opting out of arbitration does not affect any other provision of these Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Subject to the arbitration section above, you consent to the exclusive jurisdiction and venue of the state and federal courts located in New Castle County, Delaware.
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Site after any change constitutes acceptance of the updated Terms.
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
